A leniency program provides immunity to a company or individual who reports and provides evidence of being involved in a cartel.

Comment

Also referred to as a leniency policy, such practices are used by many countries as part of enforcing antitrust laws. Because the penalties against companies involved in cartels are normally quite severe, such offer of immunity makes cartels much less stable. As the leniency program incentivizes all members of a cartel to report illegal activity to the authorities, this essentially turns the cartel into a prisoner’s dilemma. Under both EU and U.S. legislation, a company may receive total immunity if it brings first information about a previously unknown cartel and/or provides sufficient evidence as well as full cooperation. A company may receive partial immunity if it provides the investigators with significant information on a previously known cartel (but not if another company from that cartel has already applied for leniency).

Také se označuje jako politika shovívavosti. Tyto praktiky využívají země jako součást prosazování antitrustových zákonů. Jelikož postihy společností podílejících se na kartelových dohodách jsou obvykle velmi vážné, taková nabídka imunity výrazně snižuje stabilitu kartelů. Jelikož program shovívavosti motivuje všechny členy kartelu nahlásit takovou ilegální činnost příslušným orgánům, v zásadě mění kartel na vězňovo dilema. Podle předpisů EU a USA může společnost dosáhnout plné imunity, pokud přinese první informace o dříve neznámém kartelu a/nebo poskytne dostatečné důkazy a zároveň svou plnou spolupráci. Společnost může získat částečnou imunitu, pokud poskytne vyšetřovatelům podstatné informace o již známém kartelu (ale ne pokud již jiná společnost ze stejného kartelu podala žádost o shovívavost).
