Sweat of the brow is a doctrine in copyright law according to which authors are entitled to protection of their work regardless of their originality.
Following the sweat of the brow doctrine, the court decided that JackDaw’s database of websites is protected by copyright.
According to this doctrine, the mere expenditure of effort in creating a work is sufficient grounds for its protection. There are, however, other criteria for assessing what constitutes a work, including assessing a threshold of originality. Sweat of the brow was traditionally used in common law jurisdictions, but both U.S. and U.K. courts have started to move away from it.
Vynaložené úsilí je doktrína v autorském právu, podle které autoři mají právo na ochranu svých děl bez ohledu na jejich originalitu.
Soud rozhodl, že podle doktríny o vynaloženém úsilí je databáze webových stránek společnosti JackDaw chráněna autorským právem.
Podle této doktríny pouhé vynaložení úsilí při vytváření díla je dostatečným důvodem pro jeho ochranu. Existují ale i jiná kritéria pro posuzování toho, co obnáší dílo, včetně posuzování prahu originality. Doktrína vynaloženého úsilí byla tradičně posuzována v jurisdikcích angloamerického práva, ale soudy jak v USA, tak ve Spojeném království od ní začaly ustupovat.
