Definition

Subrogation is a legal principle of substituting one party with another for the purpose of enforcing a right to which the original party was entitled.

Even though the driver who bumped my car wasn’t willing to pay, I didn’t have to worry because the insurance company subrogated me.

Comment

Subrogation is used in insurance settlement, factoring, and surety. There are two types of subrogation: legal subrogation, which is written into law or is an accepted legal doctrine, and conventional subrogation, which arises from contractually arranged provisions. A waiver of subrogation is normally arranged in leases so that both the lessor and the lessee are protected by an insurance policy in case of an insured event.

Subrogace je právní princip zastoupení jedné strany jinou stranou pro účely výkonu práva, na které měla původní strana nárok.

Ačkoli řidič, který naboural moje auto, nebyl ochotný zaplatit, nemuselo mi to dělat starosti, protože mě pojišťovna subrogovala.

Poznámka

Subrogace se používá při plnění pojistného, při faktoringu, nebo ručení. Existují dva typy subrogace: zákonná subrogace, která je uvedena v zákoně nebo je přijímanou legální doktrínou, a smluvní subrogace, která vzniká ze smluvně dohodnutých ustanovení. U pronájmů se obvykle uzavírá zproštění subrogace, aby byl jak pronajímatel, tak nájemce chráněn pojistkou v případě pojistné události.
