Single branding is the practice of a supplier demanding that a distributor purchase a certain type of goods or services exclusively as designated by the supplier.
The court decided that ABC’s single branding contracts did not violate antitrust laws because the company does not hold a dominant position in its market.
Also called exclusive dealing, certain forms of such practice may be considered illegal under competition law, especially if it represents a serious barrier to entry and thus distorts competition. Single branding is a common practice, for example, within vertically integrated organizations. Third line forcing is a specific type of single branding (illegal in some jurisdictions) wherein the distributor is forced to purchase products or services exclusively from a third party designated by the supplier.
Nákup jedné značky je praxe, kdy dodavatel požaduje, aby distributor kupoval určitý typ zboží nebo služeb výlučně tak, jak stanoví dodavatel.
Soud rozhodl, že smlouvy o nákupu jedné značky společnosti ABC neporušily antitrustové zákony, protože společnost na svém trhu nedrží dominantní postavení.
Také se nazývá výhradní dohoda. Určité formy této praxe mohou být pokládány za nelegální podle soutěžního práva, především pokud představují vážnou bariéru vstupu na trh a tím deformuje hospodářskou soutěž. Nákup jedné značky je běžnou praxí například ve vertikálně integrovaných organizacích. Specifickým typem nákupu jedné značky (a ilegálním v některých jurisdikích) je third line forcing, kdy je distributor nucen kupovat výhradně produkty nebo služby od třetí strany stanovené dodavatelem.
