Definition

A debtor is a person or entity having an obligation to another party.

Example sentence

The Debtor undertakes to pay a late charge of USD 25 for each day for which an instalment is unpaid.

Comment

Most commonly, a debtor is simply someone who owes money. In the legal sense, however, an obligor (i.e., a party contractually or legally obliged to perform an obligation) may also be called a debtor. If a debtor fails to fulfil the obligation, it can be in arrears or in default and therefore subject to a penalty.

Příklad použití ve větě

Dlužník se zavazuje uhradit poplatek za prodlení ve výši 25 dolarů za každý den, kdy je některá splátka nesplacená.

Poznámka

Nejčastěji je dlužník někdo, kdo dluží peníze. V právním jazyce má však slovo dlužník obecnější význam a označuje stranu, která má smluvní nebo zákonnou povinnost splnit závazek. Pokud dlužník neplní svou povinnost, může být v prodlení, a tedy může být trestán.
