Definition

An arm’s length transaction is a transaction that is carried out between two parties under standard business terms and conditions and at market price even if the parties are closely related.

Example sentence

Some observers of the Chinese economy argue that favoritism among elites is rampant in many sectors and that only a few large transactions are truly conducted at arm’s length.

Comment

A neutral third party (such as an appraiser) will sometimes be asked to examine whether a transaction was carried out according to the arm’s length principle. For instance, if parents sell a property to their child and the ask price is too far below market value, the transaction may be regarded by tax authorities as a gift instead of a sale.

Transakce dle tržních podmínek je transakce, která je provedena mezi dvěma stranami za standardních obchodních podmínek a za tržní cenu, i když jsou strany úzce spjaty.

Příklad použití ve větě

Někteří pozorovatelé čínské ekonomiky tvrdí, že protekce mezi elitami je v mnoha oblastech nekontrolovatelná a jen málo velkých transakcí se provádí dle opravdu tržních podmínek.

Poznámka

O přezkoumání, zda transakce proběhla dle zásady tržních podmínek, je někdy požádána neutrální třetí strana (například odhadce). Chtějí-li například rodiče prodat majetek dítěti a požadovaná cena je příliš nízko pod tržní cenou, může berní úřad transakci posoudit jako dar namísto prodeje.
