Comment

Alternative dispute resolution or ADR is suitable for resolving disputes between neighbors, family members, as well as companies. Among the most common alternative dispute resolution methods are mediation and arbitration. Mediation means that a third, impartial party assists the opposing parties to resolve their disagreement using a range of communication- and negotiation-centered techniques. Arbitration is a more formal process, often used for business disputes where the parties choose an arbitrator who in the end makes (most usually) a binding decision. Advantages of ADR in comparison to court proceedings usually include lower costs, greater speed, and more control over the process by the parties. The process is also not public, and people involved in the dispute resolution need not be lawyers or judges. ADR is also well suited to resolving international disputes, including ones that are not of a commercial nature.

Mimosoudní řešení sporů je vhodné k řešení sporů mezi sousedy, rodinnými příslušníky i firmami. Mezi nejběžnější metody alternativního řešení sporů patří mediace a rozhodčí řízení. Mediace znamená, že třetí nezaujatá strana pomáhá znesvářeným stranám vyřešit jejich neshody pomocí řady technik zaměřených na komunikaci a vyjednávání. Rozhodčí řízení je formálnější proces, který se často používá pro obchodní spory, kdy si strany vyberou rozhodce, který na konci vydá (většinou) závazné rozhodnutí. Ve srovnání se soudním řízením jsou výhodou mimosoudních řešení sporů obvykle nižší náklady, větší rychlost a větší kontrola procesu ze strany účastníků. Proces také není veřejný a osoby zapojené do řešení sporu nemusí být právníci nebo soudci. Mimosoudní řešení sporů je vhodné také pro řešení mezinárodních sporů i jiné než obchodní povahy.
