An acceleration clause is a contractual provision which enables the creditor to request immediate repayment of the remaining balance from the debtor, regardless of previously agreed instalments.
The Dvoraks succeeded in convincing the bank that it should not activate the acceleration clause because of just one delayed payment.
This clause is most commonly used in mortgage loans. An acceleration clause usually becomes active only after the debtor has been in arrears for a specified period or otherwise breaches the contract. It may also be invoked in other situations, however, such as when the debtor attempts to sell the mortgaged property. The amount due includes the unpaid balance of the principal and potentially any interest that would have accrued to the creditor for the originally concluded duration of the loan. Activation of the acceleration clause is usually the creditor’s last resort before foreclosure.

Tato klauzule se nejčastěji používá v hypotečních úvěrech. Klauzule o zesplatnění úvěru se obvykle stává aktivní až poté, co je dlužník v prodlení na danou dobu nebo jinak poruší smlouvu. Může se ale uplatnit i v dalších situacích, například když se dlužník pokusí prodat daný majetek. Splatná částka zahrnuje nesplacený zůstatek jistiny a také jakékoli úroky připadající věřiteli za původně stanovenou dobu úvěru. Aktivace klauzule o zesplatnění úvěru je obvykle posledním krokem věřitele před propadnutím hypotéky.
